In a <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/x.com\/robertjdenault\/status\/2077169529684164671?s=20\" target=\"_blank\" rel=\"nofollow\">statement<\/a> posted on X, Kalshi\u2019s head of enforcement and legal counsel, Robert DeNault, said the company had already unwound the affected trades because the Michigan court required it to do so.<\/p>\n<p>\u201cWe are disappointed by this decision and believe it is unfair to Kalshi,\u201d DeNault said.\u00a0<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cWe already acted and unwound the trades, as the Michigan court order required us to do. We are being put in an impossible position, looking to follow state court orders that may contradict our federal regulatory obligations. We did not have a choice.\u201d<\/p>\n<\/blockquote>\n<p>A Kalshi spokesperson <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.reuters.com\/legal\/government\/us-derivatives-regulator-blocks-kalshi-canceling-michigan-trades-despite-court-2026-07-14\/\" target=\"_blank\" rel=\"nofollow\">told Reuters<\/a> the company is reviewing the CFTC\u2019s order and weighing its next steps.<\/p>\n<p>The regulator said Michigan became the first state to attempt to interfere with derivatives contracts after they had already been executed, describing the move as a challenge to the federal framework governing designated contract markets.<\/p>\n<p>CFTC Chair Michael Selig said canceling completed trades could create uncertainty across financial markets.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cCanceling trades that have already been executed is an unprecedented step that risks a cascading effect on the entire marketplace and undermines the certainty in contracting that is a necessary component of a functioning market,\u201d Selig said.<\/p>\n<\/blockquote>\n<p>\u201cThe Commission will not allow states or state courts to bully registered entities into violating the Commodity Exchange Act and CFTC regulations,\u201d he added.<\/p>\n<p>    <!-- .cn-block-related-link --><\/p>\n<p>Speaking on Fox Business last week, Selig also said it was \u201ccritical\u201d that the CFTC preserve its authority over prediction markets.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-x wp-block-embed-x\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Under my leadership, the <a rel=\"nofollow\" target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/x.com\/CFTC?ref_src=twsrc%5Etfw\">@CFTC<\/a> will continue to defend our exclusive jurisdiction over all manner of commodity derivatives, including prediction markets.<\/p>\n<p>To the states seeking to preempt our authority, we\u2019ll see you in court. <a rel=\"nofollow\" target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/t.co\/v2eLRbAEY9\">pic.twitter.com\/v2eLRbAEY9<\/a><\/p>\n<p>\u2014 Mike Selig (@ChairmanSelig) <a rel=\"nofollow\" target=\"_blank\" rel=\"nofollow\" href=\"https:\/\/x.com\/ChairmanSelig\/status\/2075565704099831956?ref_src=twsrc%5Etfw\">July 10, 2026<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>He added that the agency had already sued nine states and would continue taking legal action against any state seeking to impose civil or criminal penalties on CFTC-registered exchanges.<\/p>\n<h2 class=\"wp-block-heading\">Michigan case adds to national legal fight<\/h2>\n<p>The latest order follows a June 29 ruling by Ingham County Circuit Court Judge Rosemarie Aquilina, who temporarily barred Kalshi from offering sports event contracts to Michigan residents while the state\u2019s lawsuit proceeds. The court warned the company it could face fines of up to $120,000 per day if it failed to meet geolocation requirements.<\/p>\n<p>Michigan Attorney General Dana Nessel has argued that Kalshi\u2019s sports event contracts operate as unlicensed gambling products under the state\u2019s Lawful Sports Betting Act. Kalshi has maintained that its event contracts fall under the Commodity Exchange Act and therefore remain subject to the CFTC rather than state gaming regulators.<\/p>\n<p>Michigan is one of several states challenging Kalshi\u2019s sports contracts. Massachusetts has secured a preliminary injunction blocking the platform from offering similar products while litigation continues, and a court recently allowed state authorities to expand their complaint with new allegations, including claims that Kalshi targets users under 21.<\/p>\n<p>New York has also handed Kalshi an early setback.
