{"id":14503,"date":"2025-10-28T08:06:03","date_gmt":"2025-10-28T08:06:03","guid":{"rendered":"https:\/\/bitunikey.com\/news\/kalshi-files-federal-lawsuit-against-new-york-regulators\/"},"modified":"2025-10-28T08:06:19","modified_gmt":"2025-10-28T08:06:19","slug":"kalshi-files-federal-lawsuit-against-new-york-regulators","status":"publish","type":"post","link":"https:\/\/bitunikey.com\/news\/kalshi-files-federal-lawsuit-against-new-york-regulators\/","title":{"rendered":"Kalshi files federal lawsuit against New York regulators"},"content":{"rendered":"<p><\/p>\n<div class=\"post-detail__content blocks\">\n<p class=\"is-style-lead\">Kalshi has filed a lawsuit against New York regulators, as the state is looking to classify its sports event contracts as unlicensed gambling and enforce a cease-and-desist order threatening civil and criminal penalties.<\/p>\n<div id=\"cn-block-summary-block_80ac442d36431f6cb978e0fe5318118d\" class=\"cn-block-summary\">\n<div class=\"cn-block-summary__nav tabs\">\n        <span class=\"tabs__item is-selected\">Summary<\/span>\n    <\/div>\n<div class=\"cn-block-summary__content\">\n<ul class=\"wp-block-list\">\n<li>Kalshi has sued New York regulators in federal court after receiving a cease-and-desist notice over its sports event contracts.<\/li>\n<li>The company is seeking an injunction to block enforcement, arguing that its markets fall under federal CFTC oversight, not state gambling law.<\/li>\n<li>Despite legal pressure from multiple states, Kalshi has attracted new investor interest at valuations as high as 12 billion dollars.<\/li>\n<\/ul><\/div>\n<\/div>\n<p><!-- .cn-block-summary --><\/p>\n<p>Kalshi <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/assets.bwbx.io\/documents\/users\/iqjWHBFdfxIU\/roPQgg1W45.o\/v0\" target=\"_blank\" rel=\"nofollow\">filed<\/a> the federal complaint on Oct. 27, noting that the New York State Gaming Commission\u2019s cease-and-desist letter left the firm with \u201cno other practical choice to protect its commercial interests and those of its users except to bring this suit.\u201d<\/p>\n<p>New York\u2019s top gambling authority sent the event contract platform a formal cease and desist <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.courtlistener.com\/docket\/71766515\/17\/1\/kalshiex-llc-v-williams\/\" target=\"_blank\" rel=\"nofollow\">notice<\/a> on Oct. 24, accusing it of operating illegal sports wagering services without a state license.<\/p>\n<p>Kalshi argued that New York\u2019s actions \u201cthreaten immediate and irreparable harm\u201d not just to its platform, but also to its users and business partners.<\/p>\n<h1 class=\"wp-block-heading\">Kalshi is seeking injunctive relief in New York<\/h1>\n<p>By moving first with a federal filing, Kalshi may be looking to shift the legal battleground away from New York\u2019s state courts, where the constitutional ban on sports gambling could have led to an almost \u201cautomatic loss,\u201d according to Daniel Wallach, founder and principal of Wallach Legal LLC.<\/p>\n<p>\u201cKalshi\u2019s desperation to get this case filed in federal court ASAP likely stems from the fact that New York State has a constitutional-level prohibition against sports gambling \u2014 except through state-licensed casinos,\u201d Wallach said in a recent X <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/x.com\/WALLACHLEGAL\/status\/1983001887151444193\" target=\"_blank\" rel=\"nofollow\">post<\/a>.<\/p>\n<p>Central to Kalshi\u2019s claim is that the Commodity Exchange Act, along with its 1974 amendments, gives the CFTC \u201ccomprehensive authority over regulated exchanges,\u201d and that Congress deliberately removed any provision that would allow states like New York to interfere in the regulation of futures trading.<\/p>\n<p>By attempting to classify sports-event contracts as gambling and applying state gaming laws to a federally designated contract market, Kalshi stated that New York is stepping into a \u201cfield that Congress has preempted,\u201d creating regulatory confusion while also undermining its federally approved business model.<\/p>\n<p>    <!-- .cn-block-related-link --><\/p>\n<p>With its lawsuit, Kalshi hopes to secure declaratory and injunctive relief against the New\u202fYork\u202fState\u202fGaming\u202fCommission similar to what it achieved in states like Nevada and New Jersey, where courts temporarily barred regulators from interfering with its federally regulated contracts while the case is resolved.<\/p>\n<p>Judge Andrew P. Gordon of the U.S. District Court in Nevada has previously accepted Kalshi\u2019s argument that federally regulated event contracts fall under the CFTC\u2019s exclusive authority, but this approach has failed to gain traction in Maryland, where a judge ordered the platform to halt sports-event listings pending appeal.<\/p>\n<p>Interestingly, crypto exchange Crypto.com failed to win similar protections over its sports event markets in Nevada, where a federal judge denied its request for an injunction and ordered it to geofence the state by early November.<\/p>\n<p>Unlike in Kalshi\u2019s <a rel=\"nofollow\" target=\"_blank\" href=\"https:\/\/www.forbes.com\/sites\/danielwallach\/2025\/04\/15\/kalshis-nevada-court-win-may-be-short-lived-due-to-federal-wire-act-ban-on-sports-betting\/\" target=\"_blank\" rel=\"nofollow\">case<\/a>, where the judge focused on whether the contracts could technically qualify as swaps under the Commodity Exchange Act, the court ruled that Crypto.com\u2019s offerings did not meet the statutory definition, leaving it vulnerable to state enforcement.<\/p>\n<p>An injunctive relief in New York would give Kalshi temporary protection from state enforcement and allow it to continue offering its sports markets from Manhattan, where the company is headquartered.<\/p>\n<p>As of Oct. 28, at least eight states, including Arizona, Illinois, Maryland, Montana, Nevada, New Jersey, Ohio, and now New York, have issued cease and desist or warning letters against Kalshi\u2019s sports event markets.
